Terms of service

These Terms of Service govern your use of marettimostudio.com (the “Site”) and any purchase you make from us. By using the Site or placing an order you agree to these Terms. Please read them carefully.

1. Who we are

The Site is operated by Jan Kamiński, trading as Marettimo Studio Jan Kamiński, a sole trader registered in Poland under NIP 5592071633 (“we”, “us”, “Marettimo”). You can contact us at hello@marettimostudio.com.

2. Eligibility

To buy from us you must be at least 18 years old and have legal capacity to enter into a binding contract. By placing an order you confirm that this is the case.

3. Products and pricing

All product descriptions, colours and images are provided in good faith but slight variations between the photographs and the goods you receive may occur, particularly with natural fabrics. All prices are shown in GBP (£) and include UK VAT at 20%. We may correct any obvious pricing or description errors at any time before your order is accepted.

4. Order acceptance

When you place an order we send you an order acknowledgement email. This is not yet an acceptance. A binding contract is formed only when we send you a dispatch confirmation. We may refuse or cancel an order in our reasonable discretion before dispatch, including (for example) if an item is out of stock, if we suspect fraud or payment failure, or if a pricing error has occurred. In such cases we will refund any payment already taken.

5. Payment

Payment is taken at checkout via Shopify Payments, PayPal or another payment method offered on the Site. By submitting payment details you authorise us (or our payment processor) to charge the full amount of your order.

6. Delivery

Delivery times, costs and locations are set out in our Shipping Policy, which forms part of these Terms.

7. Returns, cancellation and consumer rights

Your right to cancel under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and the conditions for returning items, are set out in our Refund Policy. Nothing in these Terms affects your statutory rights as a consumer, including the rights under the Consumer Rights Act 2015 that goods must be of satisfactory quality, fit for purpose and as described.

8. Intellectual property

The Site, all content on it (including logos, photographs, copy, product designs and the Marettimo wordmark) and all underlying software are owned by or licensed to Marettimo Studio. You may view and print content for personal, non-commercial use only. You may not copy, distribute, modify, reproduce, scrape or use any content for any commercial purpose without our prior written consent.

9. Acceptable use

You agree not to use the Site in any way that is unlawful, fraudulent, defamatory, harmful, abusive or that infringes third-party rights, and not to attempt to access, interfere with or disrupt the Site or its underlying systems.

10. Limitation of liability

Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or for any other liability that cannot be excluded under English law. Subject to that, our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses (such as loss of profit, loss of opportunity or loss of data) arising out of your use of the Site.

11. Force majeure

We are not liable for delay or failure to perform our obligations if caused by events outside our reasonable control (including strikes, postal disruption, carrier failure, customs action, war, civil unrest, natural disasters or pandemic restrictions). We will let you know promptly if such an event affects your order.

12. Privacy

Our handling of your personal data is described in our Privacy Policy.

13. Changes to these Terms

We may amend these Terms from time to time. The version applying to your order is the one in force at the moment you place it.

14. Governing law and jurisdiction

These Terms and any dispute arising out of them are governed by the laws of England and Wales. If you are a UK consumer, you may bring legal proceedings in the courts of England and Wales or, where applicable, in the courts of your country of residence. Nothing in these Terms affects your right as a consumer to rely on mandatory consumer protection rules of the country in which you live.

15. Alternative dispute resolution

If you have a complaint we cannot resolve, you may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr, although please email us first and we will do our best to put things right.
